Terms and Conditions

Welcome to Leisurery.com, a hotel booking platform operated by Leisurery Stays (PVT) LTD, a private limited company incorporated and registered under the laws of the Democratic Socialist Republic of Sri Lanka (Company Registration No. to be inserted). Our registered office is located in Sri Lanka.

These Terms and Conditions ("Terms") govern your access to and use of the Leisurery.com website, mobile applications, and related services (collectively, the "Platform"). By creating an account, making a booking, or otherwise using the Platform, you confirm that you have read, understood, and agreed to these Terms in full.

If you do not agree with any part of these Terms, you must immediately stop using the Platform.

• "We", "Us", "Our" — Leisurery Stays (PVT) LTD, trading as Leisurery.com.
• "Platform" — the Leisurery.com website, APIs, and any associated mobile or web applications.
• "User", "You" — any individual or entity accessing or using the Platform.
• "Hotel Partner" — a hotel, guesthouse, villa, or other accommodation provider listed on the Platform.
• "Booking" — a confirmed reservation made through the Platform for accommodation services.
• "Content" — all text, images, reviews, data, and materials available on or submitted to the Platform.

You may use the Platform only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Platform in any way that violates applicable Sri Lankan law or international law.
• Make fraudulent, speculative, or false bookings.
• Attempt to gain unauthorised access to any part of the Platform or its related systems.
• Engage in scraping, data-mining, or automated access without our prior written consent.
• Post or transmit any harmful, offensive, or misleading content.
• Impersonate any person or entity or misrepresent your affiliation with any person or entity.

We reserve the right to suspend or terminate access for any User who violates these Terms, at our sole discretion and without prior notice.

To make a booking you must register for an account. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date.

You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. Notify us immediately at support@leisurery.com if you suspect any unauthorised use of your account.

You must be at least 18 years of age to create an account and make bookings on the Platform.

When you submit a booking request through the Platform, you are making an offer to purchase accommodation services from the relevant Hotel Partner. A booking is only confirmed when you receive a written booking confirmation from us by email.

Leisurery.com acts as an intermediary between you and Hotel Partners. We are not a party to the accommodation contract between you and the Hotel Partner; however, we facilitate the booking and payment process on their behalf.

Room availability, pricing, and policies displayed on the Platform are provided by Hotel Partners and are subject to change. We do not guarantee that listed rooms will be available at all times.

It is your responsibility to verify all booking details — including dates, room type, guest count, and special requests — before confirming a reservation.

All prices displayed on the Platform are in US Dollars (USD) unless otherwise stated. Prices include applicable taxes and fees as indicated at checkout.

Payments are processed securely through our third-party payment provider (Stripe). By making a payment, you also agree to the payment provider's terms of service. Leisurery Stays (PVT) LTD does not store your full card details on our servers.

In the event of a payment failure or dispute, please contact us at support@leisurery.com within 30 days of the transaction date.

Cancellation and refund policies vary by Hotel Partner and are clearly stated on each hotel's listing page and confirmed in your booking confirmation email. Please review these carefully before completing your booking.

Where a Hotel Partner's policy permits a refund, we will process the refund to your original payment method within 7–14 business days of the cancellation being approved.

Leisurery.com service fees (if any) are non-refundable unless the cancellation is due to an error on our part or a material failure of service.

In cases of force majeure (including natural disasters, government-ordered travel restrictions, or similar circumstances), we will work in good faith with both guests and Hotel Partners to facilitate fair outcomes, but we do not guarantee refunds beyond what the Hotel Partner's policy allows.

You agree that any reviews, ratings, or content you submit to the Platform will be honest, accurate, and based on your genuine experience. We reserve the right to remove content that is fraudulent, defamatory, offensive, or otherwise in violation of these Terms.

You must not use the Platform to harass, threaten, or abuse Hotel Partners, other users, or our staff.

All content on the Platform — including but not limited to logos, trademarks, software, design elements, and written content — is the property of Leisurery Stays (PVT) LTD or its licensors and is protected under the Intellectual Property Act No. 36 of 2003 (Sri Lanka) and applicable international intellectual property laws.

You may not copy, reproduce, distribute, modify, or create derivative works of any Platform content without our prior written consent.

By submitting content (such as reviews or photos) to the Platform, you grant Leisurery Stays (PVT) LTD a non-exclusive, royalty-free, worldwide licence to use, display, and distribute that content in connection with the operation of the Platform.

To the maximum extent permitted by applicable Sri Lankan law, Leisurery Stays (PVT) LTD and its directors, employees, and agents shall not be liable for:

• Any indirect, incidental, special, or consequential damages arising from your use of the Platform.
• Any loss of revenue, profit, data, or goodwill.
• The conduct, acts, or omissions of Hotel Partners or third parties.
• Any inaccuracies in hotel listings, photos, or descriptions provided by Hotel Partners.
• Any disruption, suspension, or termination of the Platform.

Our total aggregate liability to you shall not exceed the amount paid by you for the specific booking giving rise to the claim.

Nothing in these Terms limits liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

You agree to indemnify, defend, and hold harmless Leisurery Stays (PVT) LTD, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from your use of the Platform, your violation of these Terms, or your infringement of any third-party rights.

These Terms shall be governed by and construed in accordance with the laws of the Democratic Socialist Republic of Sri Lanka. Any dispute arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Sri Lanka.

We encourage you to contact us first to resolve any concerns informally before pursuing formal legal action.

We may update these Terms from time to time to reflect changes in our services, legal requirements, or business practices. We will notify registered users of material changes by email and will update the "Effective date" at the top of this page.

Your continued use of the Platform after any changes are posted constitutes your acceptance of the revised Terms.
